Before any asbestos abatement project can legally begin in New York City, a permit must be obtained from the NYC Department of Environmental Protection (DEP). This requirement applies to all five boroughs and to any project that will disturb asbestos-containing materials — regardless of the building’s size or the scope of the work. This guide walks through every step of the 2026 NYC DEP asbestos permit process.
Who Needs a NYC DEP Asbestos Permit
A NYC DEP asbestos permit is required for any project that will disturb asbestos-containing material (ACM) in New York City, including:
- Renovation or demolition of any pre-1980 structure
- Removal of floor tiles, pipe insulation, ceiling tiles, or drywall joint compound in covered buildings
- Abatement as part of a water damage, fire damage, or structural repair project
- Any commercial tenant improvement or fit-out in pre-1980 buildings
The permit is required even if the asbestos survey comes back negative — the survey results must be submitted to DEP as part of the notification process.
Step 1: Asbestos Survey (Required Before Permit Application)
Before applying for a permit, you must have a licensed NYS asbestos inspector conduct a survey of all materials that will be disturbed by the planned work. As of 2026, chain-of-custody documentation from sample collection through lab analysis is required. The surveyor must be licensed under NYS Labor Law Article 32 — not just a general inspector.
Survey turnaround: 3–7 business days standard; 24-hour rush available. Budget 1–2 weeks for this step.
Step 2: File the ACP-5 or ACP-7 Form
NYC DEP uses two primary permit forms depending on the scope of work:
- ACP-5: Filed when the survey finds NO asbestos-containing materials in the work area. This certifies the project is asbestos-free and allows work to proceed without further DEP involvement. As of January 2026, ACP-5 forms must be filed digitally via DEP eFiling — paper submissions are no longer accepted.
- ACP-7: Filed when ACM is present and abatement is required. This initiates the permit process and requires the licensed abatement contractor to be identified at filing.
Step 3: ACP-7 Permit Application Requirements
For projects requiring abatement (ACP-7), the following must be submitted via DEP eFiling:
- Completed ACP-7 form with project address, scope of work, and estimated ACM quantity
- Survey report with chain-of-custody lab documentation
- Licensed abatement contractor’s current ASTP license number (verified against NYS DOL database at submission)
- Contractor’s insurance certificate meeting NYC DEP minimums ($1M per occurrence)
- Signed Homeowner Notification (for residential projects) or Tenant Notification (for commercial)
Step 4: DEP Review and Permit Issuance
Standard DEP review takes 3–10 business days in 2026. Emergency permits are available for casualty events (fire, flood, structural failure) and can be issued within 24–48 hours with proper documentation. No abatement work may begin before the permit is issued — violations carry fines starting at $5,000 per day.
Step 5: Active Abatement — Regulatory Requirements
During abatement, the licensed contractor must:
- Post the DEP permit number at the job site entrance
- Maintain a negative air pressure enclosure for all friable asbestos removal
- Use HEPA filtration equipment throughout the containment area
- Dispose of all ACM waste at a permitted facility with a signed manifest
Step 6: Post-Abatement Air Clearance and Project Closeout
After abatement is complete, an independent licensed air monitoring contractor (separate from the abatement contractor) must conduct post-abatement air clearance testing. Results must meet OSHA and NIOSH clearance standards before the containment can be broken and the area reoccupied. The clearance test results and abatement contractor completion documentation are submitted to DEP to close out the permit.
